To qualify for Area Payments, the area must be owned or used by the applicant.
Every farmer can qualify for area payments for the area of agricultural land (AAL) only if it is owned or used by the farmer on June 15 of the current year.
If this land is not the property of the farmer, as evidenced by an entry in the Cadastral Register of the State Land Service, then the farm must keep written confirmations of the right to manage the LFA applied for support and they will have to be presented upon request by the RSS.

Written confirmation can be:
-lease agreement;
-purchase agreement;
-loan agreement;
-gift agreement;
-document certifying inheritance;
-parish decision, etc.

It is also possible exceptional certificates with regard to the requirements declared in the Area Payment Application:
-a personal written confirmation from the land owner or his authorized representative;
-in exceptional cases, if the applicant has an agreement with the land owner or his authorized representative regarding permission to manage the specific plot of land, but this agreement cannot be drawn up in writing, a single written confirmation from the applicant is permissible.

It is very important to indicate in the exceptional certificates of the right to manage the LIF the number and area (ha) of the relevant field declared for support in the application, the specific block of land or cadastre number and the owner, address and contact information. The RSS will contact the relevant landowner to verify the rights of the specific farmer to manage the LIF area applied for support. If the landowner does not confirm that there is an agreement with the farmer on the management of the LIF area, support will not be granted for the specific field in the current year and this relevant area will be taken into account when determining the reductions in the amount of support for the re-declaration of the area.
